These Terms govern your use of Cutty. Cutty is built for discovering, rating, discussing, and listening to music. Use the service lawfully, respect other people, and publish only content you have the right to share.
Acceptance of these Terms
By downloading, accessing, or using Cutty, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. If you use Cutty on behalf of an organization, you represent that you are authorized to accept these Terms for it.
Eligibility and accounts
You must be at least 13 years old and legally able to agree to these Terms. If the law where you live requires permission from a parent or guardian, you may use Cutty only with that permission.
Give us accurate account information and keep your sign-in methods secure. You are responsible for activity performed through your account. Notify us promptly if you believe your account has been compromised. You may not impersonate another person, sell or transfer an account, or create an account for someone without permission.
Your license to use Cutty
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Cutty for its intended purposes on devices you own or control. The Apple Standard Licensed Application End User License Agreement also applies to the iOS app where required by the App Store.
This license does not let you copy, sell, rent, sublicense, distribute, reverse engineer, bypass security, extract source code except where applicable law expressly permits it, or use the service to build a competing product.
Your content
You keep ownership of ratings, notes, reviews, comments, profile information, images, playlists, and other content you submit. You are responsible for that content and must have all rights and permissions needed to publish it.
You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute your content only as needed to operate, secure, and improve Cutty and to make the content available according to the feature and visibility settings you choose. This license ends when the content is deleted from active systems, except for reasonable backup retention, content other users have independently shared, and records we must retain for safety or legal reasons.
You may remove your content using available app controls. Deleting your account is governed by the account-deletion section below.
Acceptable use
You may not use Cutty to:
- Break the law, violate another person's rights, or encourage unlawful conduct.
- Post harassment, threats, hate, targeted abuse, sexually exploitative content, or content that endangers minors.
- Post content you do not have permission to share, including infringing music, images, or personal information.
- Impersonate others, misrepresent affiliation, manipulate engagement, send spam, or coordinate deceptive activity.
- Upload malware, probe for vulnerabilities, interfere with service operation, evade access controls, or access another account without permission.
- Scrape, harvest, or use automated systems to access the service except through an interface we expressly provide or with our written permission.
- Abuse reporting, blocking, authentication, playback, or other features.
Reporting, blocking, and moderation
You can report objectionable content or accounts and can block other accounts through the relevant menu in Cutty. We may review reports, remove or limit content, restrict features, preserve evidence, warn or suspend accounts, or terminate access when we reasonably believe content or conduct violates these Terms, threatens safety, exposes the service to risk, or must be addressed by law.
We are not obligated to pre-screen every item and cannot guarantee that all objectionable content will be removed immediately. Do not use Cutty to report an emergency; contact the appropriate emergency service.
Apple Music and third-party services
Cutty uses MusicKit and Apple Music catalog information to support search, artwork, previews, playback, and music actions you request. Apple controls catalog availability, subscription eligibility, playback, and library behavior. Full-length playback may require an Apple Music subscription. Catalog entries, artwork, links, and playback may change or become unavailable without notice.
Cutty may link to Apple Music, Spotify search, or other third-party services. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services and do not grant rights to their content, trademarks, or technology.
Our service and intellectual property
Cutty and its software, design, branding, and service content—other than user content and third-party materials—are owned by us or our licensors and are protected by applicable law. These Terms grant only the limited license described above. No other rights are transferred.
If you send feedback or suggestions, you allow us to use them without restriction or compensation, but you are not required to provide feedback.
Changes to the service
We may add, change, suspend, or discontinue features, including Daily Spin selections, social features, catalog integrations, and beta functionality. We will try to provide reasonable notice when a change materially affects your use, but urgent security, safety, legal, or technical changes may take effect immediately.
Account deletion, suspension, and termination
You may stop using Cutty at any time. You can delete your account from Profile → Settings → Delete Account. Deletion removes application-owned account data and starts deletion of the associated authentication identity, subject to limited backup, safety, and legal retention described in the Privacy Policy.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, interfere with the service, or if suspension is required to protect users or comply with law. When appropriate, we may give notice and an opportunity to address the issue. Provisions that by their nature should survive termination, including ownership, disclaimers, and limitations of liability, will survive.
Disclaimers
To the fullest extent permitted by law, Cutty is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not promise uninterrupted or error-free operation, that content will always be accurate or available, or that the service will meet every requirement. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Ratings, reviews, comments, playlists, and other user content reflect the views of their authors, not Cutty. They are provided for discovery and discussion, not as professional advice.
Limitation of liability
To the fullest extent permitted by law, we and our service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, use, profits, or opportunities arising from or related to Cutty. Nothing in these Terms limits liability that cannot lawfully be limited, and mandatory consumer rights remain unaffected.
Changes to these Terms
We may update these Terms as the service changes. The date above shows when they were last revised. If a change materially affects your rights, we will provide reasonable notice in the app or by another appropriate method before it takes effect when required. Continuing to use Cutty after updated Terms take effect means you accept them.
General
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them as part of a merger, acquisition, financing, reorganization, or sale of assets. Applicable mandatory consumer-protection rights are not limited by these Terms.
